Acceptance of Terms
By using the Forethought Mobile App on an Apple device, you indicate your agreement to the standard Apple Terms of Use (EULA).
By using the Forethought App on an Android or other device running Android OS, you indicate your agreement to the Google Play Terms of Service.
By using the Forethought App and/or website, you also indicate your agreement to the terms listed below. In the app, you will also be shown these terms when you first open the app. Scroll to the bottom, check the box that says "I accept these terms," and click the "Accept" button. By doing so, you indicate your agreement to these Terms.
Not a Will
The Forethought Mobile App is designed to store data for survivors in an encrypted vault and is not intended to serve as a will or a substitute for a will.
Acceptable Use and Legal Compliance
By using the Forethought Mobile App or associated web application, you agree to use this application solely for lawful purposes and in accordance with all applicable local, state, national, and international laws and regulations. You commit not to engage in any use of the application that is prohibited in your jurisdiction, infringes on the rights of others, or involves the uploading or sharing of illegal or harmful attachment files. Violations may result in the termination of your access to the application and legal action.
Secure Data Storage
While the App employs best-in-class encryption methods comparable to what banks and government agencies use, it should not be used for storing sensitive information like passwords and PINs.
Data Backup and Potential Loss
Your data will be backed up on our servers. Although we make every effort to ensure data integrity, in the event that these servers are compromised or damaged, your data could be lost.
Access to Your Vault
It is your responsibility to ensure that a trusted individual has access to your device to view the vault. Alternatively, you may subscribe to our Premium plan, which allows you to designate one or more individuals as Vault Keepers, granting them access to your encrypted vault stored online.
Vault Keepers
If you choose to invite Vault Keepers, they are not considered as such until they complete the necessary security checks. It is your responsibility to ensure that your chosen Vault Keepers complete these checks.
Data Availability
Should your vault be unlocked, the data within it will be available to the Vault Keepers for 90 days after subscription payments cease.
Changes to Terms
We reserve the right to modify or replace these Terms at any time. The most current version of these Terms will be posted on our website. Your continued use of the App constitutes your acceptance of any changes to these Terms.
Termination
We reserve the right to terminate or suspend access to our App at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to us, the App, its users, or third parties, or for other reasons.
Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of law principles.
